Frequently Asked Questions (FAQs)

What is co-employment?
Co-employment is the contractual arrangement between the client and the Professional Employer Organization (PEO) that allows the PEO to provide a full range of services and to transfer or share many employer liabilities. Each party is responsible for certain employment obligations, while both parties share responsibility for other employment obligations.

When evaluating the employer role of either the PEO or the client, the facts and circumstances of each employer obligation should be examined separately, since neither party alone is responsible for performing all of the obligations of employment. Workers become employees of two employers: the client retains supervision for production or delivery of services, and the PEO assumes responsibility for human resources and personnel services.

What is the difference between a PEO versus an ASO?
The key difference between the Administrative Service Organization (ASO) and PEO model is that there is no co-employment relationship in the ASO. For some companies, the desire to maintain more choice and control over their employees and benefits plans, while utilizing select features of an outsourcing arrangement, makes the ASO a better choice. In an ASO, you maintain total control.

How is a PEO different from human resources outsourcing?
As a human resources outsourcing provider, XMi Human Resource Solutions can provide similar services as a PEO; however, as a human resources outsourcing provider, we would not offer a co-employment relationship.
